Terms of Service

These Terms of Service ("Terms") govern your use of the Manifold hosted product at manifold.app (the "Service") operated by the Manifold team ("we," "us," "our"). By creating an account, logging in, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you self-host Manifold under its open-source license, these Terms do not apply to your deployment — the open-source license terms do.

1. Eligibility and accounts

You must be at least 16 years old and able to enter a binding contract. You are responsible for the security of your account credentials, all activity that occurs under your account, and the conduct of any teammates you invite. Notify us immediately at security@manifold.app of any unauthorized access. We may suspend accounts that we believe have been compromised until ownership is verified.

2. The Service

Manifold is a cross-platform publishing tool. It lets you author one source post, generate per-platform variants, schedule them, and publish to connected social networks and content endpoints. The Service depends on third-party platform APIs (LinkedIn, X, Instagram, Facebook, Reddit, Pinterest, WordPress, YouTube, Imgur, OpenAI). Their availability, terms, rate limits, and policy changes affect what the Service can do; we don't control them.

3. Your content

You retain all rights, title, and interest in the content you upload, draft, or publish through the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, transform (e.g., resize media, render quote cards), and display your content solely as needed to operate the Service for you. This license ends when you delete the content or close your account, except as needed to comply with legal obligations or to retain backups for the period stated in our Privacy Policy.

You represent and warrant that (a) you have the rights to the content you publish through the Service and (b) the content does not violate any third party's intellectual property, privacy, publicity, or other rights.

4. Acceptable use

You agree not to:

  • Use the Service to publish content that is illegal in your jurisdiction or the target platform's.
  • Use the Service to harass, defame, dox, or threaten any person.
  • Use the Service to send unsolicited bulk messages or otherwise spam connected platforms.
  • Use the Service to publish or distribute malware, exploits, or sexually explicit content involving minors.
  • Attempt to gain unauthorized access to the Service, other accounts, or connected platform accounts.
  • Reverse-engineer, decompile, or extract source code from the hosted Service (the open-source version is separately licensed; that's where to read the code).
  • Resell, sublicense, or "white-label" the hosted Service without our written permission.
  • Use the Service in a way that violates the terms of a connected platform (LinkedIn's, X's, Instagram's, etc., Terms of Service apply when you publish through them).

5. Third-party services

When you connect a platform (e.g., LinkedIn), you are also subject to that platform's terms of service. We are not responsible for changes those platforms make to their APIs, rate limits, content policies, or account standing. If a platform suspends your account, the Service cannot publish on your behalf to that platform until it is restored.

6. Subscriptions and billing

Paid plans are billed monthly or annually in advance, in US dollars, via our payment processor. By providing payment information, you authorize us to charge the recurring fee for your plan plus any applicable taxes until you cancel. You can cancel at any time from the panel; cancellation takes effect at the end of the current billing period. We do not refund partial periods except where required by law.

Fees may change with at least 30 days' notice; changes apply at your next renewal. Continued use after the change constitutes acceptance.

7. Free plans and trials

The Starter plan is free for one brand and provided as-is. We may rate-limit, throttle, or terminate free accounts that we believe are being abused. Trials, if offered, convert to paid at the end of the trial period unless you cancel.

8. Termination

You may terminate your account at any time from the panel or by emailing hello@manifold.app. We may suspend or terminate your account immediately if you materially breach these Terms, abuse the Service, or fail to pay. On termination, your right to use the Service ends; data is retained per the Privacy Policy's retention schedule.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any publish attempt will succeed. We do not warrant the content, accuracy, or availability of connected third-party platforms.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR REPUTATIONAL HARM) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms; (b) your content; (c) your violation of any third party's rights, including a connected platform's terms.

12. Intellectual property

Manifold, the Manifold name and mark, and the hosted application are owned by us and protected by intellectual-property laws. The open-source codebase is separately licensed under Apache 2.0 (see the repository's LICENSE file). Nothing in these Terms grants you any right to use our trademarks except as needed to identify the Service in non-misleading contexts.

13. Copyright (DMCA)

We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act. Send notices to dmca@manifold.app. We may remove or disable access to content that is the subject of a properly-formed notice and may terminate the accounts of repeat infringers.

14. Changes to these Terms

We may revise these Terms as the Service evolves. Material changes will be announced in-product and emailed to account holders at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing here prevents either party from seeking injunctive relief in any court of competent jurisdiction for misuse of intellectual property.

16. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a corporate transaction. These Terms (together with the Privacy Policy) are the entire agreement between you and us regarding the hosted Service and supersede prior agreements on the subject.

Note for operators: These Terms are written to industry-standard SaaS conventions but are not legal advice. Choice of law, dispute-resolution forum (court vs. arbitration), liability cap, indemnity scope, and consumer-protection carve-outs all depend on your jurisdiction and customer base. Have qualified counsel review before public launch.
